No, it has less to do with that, and more to do with the fact that, at least from my understanding, he paid for the rights to use that spawn. If he paid to own the world/spawn, then he can release the download and all that. If he only paid for the right to use it on the server, he's not allowed to do that.

Luckily we already have the Alpha and Beta towns available for download here on the forum.

It seems like people would really like the downloads for some old spawns. Is that something that seems likely?
